UPDATE: Driver charged after passenger is killed in crash with dump truck

UPDATE (WKOW) — A Delavan man is charged with two felonies after police say he crashed into a parked dump truck. His passenger, Derek Lee Garber, was killed.

Joseph Overbeek, 20, was charged with homicide by intoxicated use of a vehicle and knowingly operating while suspended (causing death).

A judge gave him a cash bond of $20,000 in his initial appearance Monday.


MILTON (WKOW) — The man killed early Sunday in Milton when the car he was in crashed into a parked dump truck has been identified as Derek Lee Garber, 20, Milton.

The driver, Joseph R. Overbeek, 20, was arrested and is facing possible charges of homicide by intoxicated use of a motor vehicle, operating after suspension causing death and other traffic charges.

According to the Milton Police Department, the crash happened on High Street around 3 a.m. Sept. 8.

They say a Chevrolet Cobalt driven by Overbeek hit a parked dump truck. Overbeek received minor injuries.

Garber was severely injured and was immediately taken to Mercy Hospital, where he later died, according to police.

Their investigation showed that speed wasn’t a factor but neither people in the car were wearing seat belts at the time of the crash.
